Port Douglas Penthouse – Terms & Conditions

Welcome to Port Douglas Penthouse. We look forward to making your stay relaxing and memorable. By making a booking directly with us, you agree to the following Terms & Conditions.

Bookings made through Airbnb, Booking.com or other third-party booking platforms remain subject to the terms and conditions of those platforms where applicable.

Bookings

Bookings may be made via our website, email or telephone.

A booking is confirmed once payment has been received and you have received a confirmation email.

Guests are responsible for ensuring all booking details are accurate at the time of booking.

Occupancy

The apartment accommodates a maximum of 11 guests, including children.

Only the guests included in the booking may stay at the property unless prior written approval has been obtained.

Check-in & Check-out

Check-in: From 3:00 pm

Check-out: By 10:00 am

The property offers self check-in. Check-in instructions will be provided prior to arrival.

Late check-out may incur additional charges if not arranged in advance.

House Rules

To ensure an enjoyable stay for everyone, guests agree to:

• Treat the property with care and respect.
• Leave the property in a reasonable condition.
• Respect neighbours and keep noise to an appropriate level.
• Comply with all local laws and regulations.

The following are strictly prohibited:

• Smoking or vaping anywhere inside the property.
• Schoolies bookings.
• Pets.
• Illegal activities.

Failure to comply with these rules may result in immediate termination of your stay without refund.

Cleaning

A cleaning fee is included in your booking.

The property should be left in a reasonably tidy condition upon departure. Excessive cleaning required due to misuse or neglect may incur additional charges.

Damage to Property

Guests are responsible for any damage beyond normal wear and tear.

We reserve the right to charge guests for the reasonable cost of repairing or replacing damaged property, furnishings, fixtures or fittings after departure.

Where possible, photographic evidence and invoices will be provided.

Cancellations

Please refer to our separate Cancellation & Refund Policy, which forms part of these Terms & Conditions.

Early Departure

If guests choose to shorten their stay or depart before the scheduled check-out date, no refund will be provided.

Circumstances Beyond Our Control

Occasionally events beyond our reasonable control may affect your booking. These may include, but are not limited to:

• Cyclones
• Flooding
• Severe weather
• Bushfires
• Government restrictions
• Utility outages
• Other emergency events

Where these events make the accommodation unavailable or unsafe, we will work with guests in good faith to offer an alternative booking date where possible or provide a refund where required by Australian Consumer Law.

We are not liable for additional travel costs, airline changes, loss of enjoyment or other consequential expenses arising from these events.

Liability

Guests use the property at their own risk.

To the maximum extent permitted by law, Port Douglas Penthouse accepts no responsibility for loss, theft, damage to personal belongings or injury occurring during your stay except where caused by our negligence or where liability cannot be excluded under Australian Consumer Law.

Parents and guardians are responsible for supervising children at all times.

Privacy

Any personal information collected during the booking process is used solely for managing your reservation and communicating with you regarding your stay.

We will never sell your personal information to third parties.

Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.

Any disputes arising from your booking will be subject to the jurisdiction of the courts of Queensland.
